海牙规则、维斯比规则、汉堡规则之间的七大区别

一、承运人的责任基础不同

  《海牙规则》由于在当时的历史背景下,船东的强大势力和航运技术条件的限制决定了《海牙规则》对承运人 的要求不会十分严格,因此《海牙规则》对承运人责任基础采用了“不完全过失原则”。《维斯比规则》对这点没加任何修订。《汉堡规则》则将其改为了“推定的 完全过失原则”。

  所谓“过失原则”是指有过失即负责,无过失即不负责,一般国家的民法多采用这一原则为基础。《海牙规 则》总的规定也是要求承运人对自己的过失承担责任,但同时又规定“船长、船员、引航员或承运人的雇佣人员在驾驶或管理船舶上的行为、疏忽或不履行契约”可 以要求免责(也是《海牙规则》遭非议最多的条款),即有过失也无须负责,因此,《海牙规则》被认为采用的是不完全过失原则。比起过失原则,这种责任制度虽 然对承运人网开一面,但在当时的历史条件下还是有着明显的进步意义的。

  《汉堡规则》的立场则严格得多,它不仅以是否存在过失来决定承运人是否负责,而且规定举证责任也要由承 运人承担,即第五条规定的“除非承运人证明他本人,其受雇人或代理人为避免该事故发生及其后果已采取了一切所能合理要求的措施,否则承运人应对货物灭失或 损坏或延迟交货所造成的损失负赔偿责任……。”这样承运人的责任大大加重了。

租船业务概述

  一、.特点:国际贸易运输中另一种重要的船舶经营方式是租船运输(CHARTERING),船东(或二船东)向租船人之间提供的不是运输劳务,而是船舶的使用权。船东和租船人之间所进行的租船业务是对外贸易的一种商业行为,也叫无形贸易,租船通常在租船市场上进行。在那里,船东(SHIP OWNER),租船人(CHARTERER),船舶经纪人(SHIP BROKER)聚集在一起,互通情报,提供船舶和货源,进行租船活动。在租船市场上,大宗交易常常是通过经纪人进行的。他们拥有广泛的业务联系渠道,能向船方提供咨询消息和向租船人提供船源情况,促使双方选择适当的洽谈对象。交易成功,经纪人就可取得一定的报酬,船舶经纪人除促成船舶租赁业务外,还代办船舶买卖,船舶代理等业务。他们的主要作用是为委托人提供最合适,最有利的生意,提供市场行情,当事人资信及答复委托人的咨询,为当事人双方斡旋并解决困难。具有如下特点:
  (1)属不定期船,没有固定的航线,装卸港及航期。
  (2)没有固定的运价。
  (3)租船运输中的提单不是一个独立的文件。船方出具的提单一般为只有正面内容的简式提单,并注明 “ALL TERMS ANDCONDITIONS AS PER CHARTER PARTY”,或 “FREIGHT PAYABLE AS PER CHARTER PARTY”。这种提单要受租船契约约束,银行不乐意接受这类提单,除非信用证另有规定。
  (4)租船运输中的船舶港口使用费,装卸费及船期延误按租船合同规定划分及计算,而班轮运输中船舶中的一切正常营运支出均由船方负担。
  (5)租船主要是用来运输国际贸易中的大宗货。
